			<content:encoded><![CDATA[<p>Sweepstakes machines seized in a raid of a Bluffton business are tools for illegal gambling, a magistrate judge ruled Tuesday.</p>
<p>Magistrate Judge Darlene Smiths order said state law bans the video gaming machines created by HEST Technologies that were confiscated by the Beaufort County Sheriffs Office in September from a Bluffton operation. </p>
<p>She also ordered that the confiscated machines be destroyed.</p>
<p>Other magistrates across the state have reached a different conclusion, with five of them ruling in favor of HEST and similar machine manufacturers from Greenville to Richland counties, according to court documents.     </p>
<p>Smiths order said the machines are illegal because they offer games of chance and customers pay to play, even if they dont insert money or tokens into the machines.</p>
<p>At the store, players would participate in the sweepstakes by making a donation to charity or requesting a free entry from a clerk, with up to four free entries offered per customer per day. The clerk would then give the customers a randomly generated pin number that determined if they won money. </p>
<p>The players could collect money on the spot from the clerk if the number was a winner or use it to play games on a computer that revealed if they won.</p>
<p>Smith ruled the pin number is the thing of value and deemed the clerk at the register an extension of the machine, and just a means to avoid depositing money directly.</p>
<p>Instead of having a coin slot, they had a clerk accepting money, said Carra Henderson, 14th Judicial Circuit assistant solicitor, who argued the case for the state. Instead of placing a bet, they called it a donation. Instead of having a lever on a machine, they used a mouse to click a start button.</p>
<p>HEST can dress things up as much as they want, but the bottom line is that these machines were being used as a tool for gambling.</p>
<p>At a Feb. 8 hearing before Smith, HEST attorney Johnny Gasser argued that the video gaming machines are legal because they dont accept or pay out money and the games they feature have no bearing on a players chances of winning. A HEST representative compared them to sweepstakes offered by McDonalds and other businesses, with predetermined prizes available only in a finite pool. </p>
<p>Gasser declined to comment on the ruling and said he is discussing what legal options to pursue next with his clients. Attempts Wednesday to reach HEST president Chris Canard and HEST spokeswoman Shannon Canard were unsuccessful.</p>
<p>Authorities have said the legality of sweepstakes and other video gaming machines probably will be decided in state Supreme Court because of differing magistrate opinions.</p>
<p>SC Law Enforcement Division director Mark Keel has said a statewide crackdown on the machines is being delayed as their legality is debated in court rulings and appeals.</p>
<p>A bill in the General Assembly also seeks to specifically outlaw the new breed of video gaming machines.</p>
<p>Duffie Stone, 14th Circuit solicitor, said Tuesday he is reviewing whether to bring criminal charges against HEST, in addition to the forfeiture proceedings decided by Smith. Misdemeanor charges of possession of unlawful gaming devices against a HEST employee, a 36-year-old Ridgeland woman who was working at the store at the time of the raid, also are pending, Stone said. </p>

<p>LONDON, Feb 13 (Reuters) &#8211; Britains top banks fell<br />
short of their government targets to lend to small businesses<br />
last year, official data showed on Monday, dealing a blow to the<br />
Conservative-led coalitions hopes of removing a barrier to<br />
economic recovery.</p>
<p>The Project Merlin deal had obliged banks to meet fixed<br />
lending targets in recompense for state aid during the financial<br />
crisis, and banks failure to meet their goal will raise<br />
pressure on the government to toughen its stance on the sector.</p>
<p>Prime Minister David Camerons government is already under<br />
fire for not doing enough to curb bank bonuses at a time when<br />
many borrowers are being hit by punitive bank charges.</p>
<p>The government is looking to the private sector to drive<br />
economic growth as it cuts spending. Since the 2007/08 financial<br />
crisis, many smaller firms have found it hard to borrow to<br />
expand, and they complain that Project Merlin failed to help<br />
them enough.</p>
<p>Britains finance ministry has already said it will not<br />
extend the agreement, and will replace it with a loan guarantee<br />
scheme aimed at lowering the cost of borrowing for small firms.</p>
<p>The Bank of England said the five banks that signed up to the<br />
Merlin agreement failed to meet their target for lending to<br />
small and medium-sized businesses, making 74.9 billion pounds<br />
($118 billion) available, below the 76 billion pound target.</p>
<p>However, banks beat their overall 190 billion pound target,<br />
making available a total 214.9 billion pounds. The figures<br />
confirm data from the British Bankers Association on Friday.</p>
<p>Treasury minister Mark Hoban said the Merlin scheme had at<br />
least encouraged banks to bring forward lending. What we need<br />
to do now is focus on &#8230; how we actually reduce the cost of<br />
credit to businesses, he told Sky television.</p>
<p>TIGHT CREDIT</p>
<p>The government had hoped that its Merlin deal with Royal<br />
Bank of Scotland, Lloyds, HSBC,<br />
Barclays and Santander UK would boost private<br />
sector investment to offset its own spending and job cuts.</p>
<p>But a survey by the Federation of Small Businesses showed<br />
that the proportion of small businesses that have used a bank<br />
overdraft or loan has fallen in the past two years.</p>
<p>Critics of the Merlin scheme argued that the targets were of<br />
little use as they only measured gross lending, not net new<br />
lending, and gauged only credit facilities made available,<br />
rather than how much money has actually been lent. The BoEs own<br />
data showed net lending fell by 9.6 billion pounds last year.</p>
<p>These targets were fairly meaningless in the first place<br />
and there are plenty of reasons to expect credit growth to<br />
remain a constraint on the economic recovery for a while yet,<br />
said Vicky Redwood of Capital Economics.</p>
<p>Britains EEF manufacturers organisation said the high cost<br />
of borrowing and stringent terms and conditions for bank loans<br />
had deterred many small firms from seeking credit.</p>
<p>The governments Credit Easing initiatives will be<br />
challenging to implement but seem to offer a prospect of making<br />
some improvement on access to finance, EEF chief economist Lee<br />
Hopley said of the loan guarantee scheme.</p>

<p>               There is an increasing focus on the lending of fixed income securities in the Australian market, according to eSecLending, a leading global securities lending agent.</p>
<p>&#8220;While equities are still being lent and demand exists there is a shift toward more focus on the fixed income space in Australia,&#8221; says Giselle Awad, a senior vice president at eSecLending. &#8220;There has been a move towards introducing tri-party agents to the market, and that has brought more international players. The RBA [Reserve Bank of Australia] is very focused on the fixed interest space in the sense of bringing more liquidity to the market. There are a lot of high-grade assets that aren&#8217;t moving around the market. By introducing tri-party repo, having more participants and encouraging repo, it does help facilitate the general liquidity in the market.&#8221;</p>
<p>There has been increased focus on lending and borrowing of fixed income assets driven by both domestic and international demand, Awad says. </p>
<p>&#8220;I think it works both ways,&#8221; Awad says. &#8220;Superannuation funds are lending their fixed income assets, and there are offshore holders of Australian fixed income that are being encouraged to lend into the market. Insurance companies in Australia may also start to play a role because of the changes to APRA [Australian Prudential Regulation Authority] rules that they&#8217;re required to hold more fixed income on their balance sheets.&#8221;</p>
<p>The Australian demand for fixed income assets to borrow is driven by market need to meet collateral obligations. Awad also points to the potential for the Australian market to then move on to lending cash in repo transactions, noting that Australia could follow on from developments in the US, in which corporate institutions that are long on cash are deriving additional revenue by using the cash in a repo transaction.</p>
<p>&#8220;This hasn&#8217;t been a focus in the Australian market as yet, but it&#8217;s applicable,&#8221; she says. &#8220;For Australia, they&#8217;re just expanding on the fixed income market and building the infrastructure, which needs to happen before cash can be placed.&#8221;</p>
<p>Meanwhile, eSecLending&#8217;s new ProxyValue service has attracted attention from clients in Australia. ProxyValue was launched last month in conjunction with Institutional Shareholder Services (ISS) to provide clients with information to balance the objectives of generating revenue through securities lending versus the corporate governance responsibilities of proxy voting. </p>
<p>&#8220;We found that there was nothing out there that says to the beneficial owner, &#8216;Here is a situation when you need to vote the proxy versus the profitability of the loan,&#8217;&#8221; says Peter Bassler, managing director of eSecLending. &#8220;As the fiduciary or the fund manager, you want to demonstrate strong corporate governance, and you want to generate the return. This gives the tools to manage the information on both of those competing objectives. It allows a client to set the metrics so they can customise on how they want to use this. It addresses a need &#8211; proxy voting is the one major right for a long holder that you give up when you loan your securities.&#8221;</p>
<p>Awad notes that ProxyValue should fit well into the Australian market.</p>
<p>&#8220;It has piqued interest, and it&#8217;s a service that we&#8217;re providing to clients for them to better manage the process and fulfil their fiduciary duties,&#8221; Awad says. &#8220;This might be one variable that might help potential clients make a decision in our favour, because it&#8217;s distinct to services in the custodial model. Australian funds do take corporate governance and voting obligations seriously, so it is something they&#8217;re interested in, and they&#8217;re familiar with ISS.&#8221;</p>

<p>The KivuWatt lending group includes the Emerging Africa Infrastructure Fund (EAIF), Netherlands Development Finance Company (FMO), the African Development Bank, and Belgian Investment Company for Developing Countries NV/SA (BIO).#xA0; This award represents the third consecutive African Power Deal of the Year prize for ContourGlobal.</p>
<p>Located at Lake Kivu in Rwanda, the KivuWatt project is an integrated methane gas extraction and production facility and associated 25 MW power plant.#xA0; When completed later this year, the project will raise and process methane gas trapped deep in the waters of Lake Kivu for use as fuel to generate critically needed electricity for the people of Rwanda, while simultaneously safely removing harmful lake gases.#xA0; KivuWatt greatly mitigates the environmental hazards associated with the natural release of these gases, reducing the risk to the two million people who live around the lake. Phase I of the project will cost approximately $142 million to complete of which $91.25 million was financed by the lending group. The effort represents the first large-scale use of the gas and will be followed by three more phases reaching 100 MW.    </p>

<p> The central bank of Georgia on<br />
Wednesday kept its key lending rate unchanged at 6.5 percent,<br />
after taking into consideration the current trends of development<br />
in the south Caucasus country.
</p>
<p>The National Bank of Georgia made the call after the meeting<br />
of its monetary policy committee.
</p>
<p>The countrys annual inflation rate was 0.5 percent in<br />
January, the lowest in more than two years and the fourth and last<br />
quarter of last year witnessed a faster-than-expected gross<br />
domestic product growth at 6.8 percent.
</p>
<p>In the past month, the central bank further reduced its key<br />
lending rate by another 0.5 percentage points to 6.5 percent. The<br />
rate was kept at 8.0 percent for almost six months early last year<br />
before starting to come down after July.
</p>
<p>Georgia ended 2010 with a 10-year-high annual inflation rate<br />
of 11.2 percent, which ended last year with an annual inflation of<br />
2 percent.
</p>
<p>But the National Bank of Georgia has warned that annual<br />
inflation rate would pick up in the second half of this year.

<p>Josephs last name is being withheld to protect his privacy, because as Wisconsins St. Croix County Sheriffs Office stated, what happened to him is shocking at best.</p>
<p>The Huffington Post reported that after inviting him to her house, Johnson and her 24 year-old sister Valerie Bartkey, a nursing assistant according to Facebook, apparently forced Joseph to drink their urine and then twisted his penis with pliers after he refused to have intercourse with Bartkey.</p>
<p>This young man has some vulnerabilities and, beside taking advantage of him, I dont think there was any other motive to it than making fun [of him], Lt. Cathy Borgschatz told The Huffington Post.</p>
<p>The sisters and some friends apparently started smoking pot, Joseph declined to partake. At first there were jokes about punching Joseph, but the violence turned real, with the sisters and another male friend stomping and kicking him. Joseph broke free, but his shoes were thrown in the toilet.</p>
<p>Joseph made his way to the porch, where Bartkey supposedly gave him a drink that she said was like lemonade. Joseph drank it, later remarking it tasted kinda like beer. Joseph was then told he just drank the girls urine.</p>
<p>According to The Huffington Post, a witness later told authorities that Joseph was later seen naked in a bedroom and heard the girls tell him to show them his penis and to bend over and show them his asshole. Bartkeys 4-year-old daughter was apparently crying in the next room.</p>
<p>Joseph said that Valerie told him she was pregnant and wanted to have twins, the police report stated. Joseph said that Valerie wanted him to do the other part and have sex with her so she could have two babies. Joseph said that Amanda was present while Valerie took her clothes off.</p>
<p>Joseph then apparently refused to have intercourse with the woman, causing her to pull on his penis with pliers. Joseph said that he didnt have an erection but Valerie wanted him to have one so she pulled on and twisted his penis with the pliers, the report continued. Joseph told Investigator Hart that Amanda was there as well and kept calling him a bitch.</p>
<p>When asked to describe the level of pain on a scale of one to ten, Joseph told authorities it was a ten.</p>
<p>The owner of the home, who is only described as AJK in the police report, entered the room, discovering the scene and told Joseph to go home. His grandmother then called the paramedics and police. Later, Johnson apparently called Joseph and threatened him for going to the police.</p>
<p>Both sisters are slated to appear in court this April. According to The Huffington Post, if they are convicted, they could face a 40-year prison sentence.</p>

<p>PUTRAJAYA: Interest in science education in schools have dropped to a critical level, said Higher Education Minister Datuk Seri Mohamed Khaled Nordin.</p>
<p>This may stunt efforts to improve technological innovations to make Malaysia a high income country, he said at the ministrys 2012 New Years message ceremony at the Putrajaya International Convention Centre.</p>
<p>Khaled said the Science and Technology Human Capital Direction Plan 2020s requirement of 60 per cent from the science stream and 40 per cent from the arts stream had yet to be achieved.</p>
<p>Whats more worrying is that the number of science stream students has dropped up to 29% since 2007. This situation continues at the university level, he said.  He said students entering universities find studying science to be difficult, boring and not worth the effort.</p>
<p>Students need to imagine of interesting and profitable career prospects after they graduate and be referred as scientists, he said.</p>
<p>Khaled called for the higher management of universities to take the matter seriously and plan to change the negative perception among students.</p>
<p>To realise this, he said, starting this year the Higher Education Ministry would offer new scholarships through the MyBrainSc programme aimed to provide quality academic staff for pure science courses in universities.</p>
<p>He also urged universities to set up research institutions in the form of institutes, centres or laboratories and creating the post of Academic Researcher as a basic need to retain talent.</p>
<p>Universities also need to be aware of plans and development which surround them, especially territorial development, so they can become a catalyst for local development and obtain income, he said.</p>
<p>He proposed for universities to create the Deputy Vice-Chancellor (Research  Innovation) post to ensure all efforts for culturalisation, research excellence and the continuation of programmes were carried out smoothly.</p>
<p>Khaled also said the amendment of the Universities and University Colleges Act (AUKU) 1971 to be implemented was not a free ticket for university students to disturb public order.</p>
<p>Ive never stopped students from being critical, but let it be done in a proper way. University students are just like other Malaysian citizens who have a responsibility towards the country, he added. BERNAMA </p>

<p>  , the largest US cable-television operator, has reported fourth-quarter results, several things stand out, given the most recent concerns about the cable industry.</p>
<p>Out of the blue, Comcast slashed its video-subscriber losses to 17,000 from 135,000 in the fourth-quarter of 2010. An improving economy explains part of it, but Comcast President Neil Smit told analysts on a conference call that it mainly stems from the companys  own efforts. &#8220;I think were focused on product innovation and better customer service. And I think weve seen kind of sustainable results from those two areas of focus.&#8221;</p>
<p>Comcast&#8217;s Xfinity service, which lets subscribers watch video on tablets and other mobile devices, now has a very user-friendly interface that the company unveiled at last year&#8217;s National Cable Show.</p>
<p>Customer service has long been a sore spot for cable, but Comcast may be seeing concrete results from a series of nationwide discussions its had with subscribers since 2007. Since then, it has instituted a number of changes to its telephone call centers and various practices related to technician visits. See related story.</p>
<p>The company plans to implement rate increases in the current quarter, which underscores another perhaps surprising aspect of its better video subscriber numbers in 4Q. Cable&#8217;s steadily rising prices have been seen as one of the factors that will lead people to cancel or downgrade their service in favor of online video providers such as Netflix Inc. </p>

<p>All of this said, Smit suggested that until housing starts improve, with more people establishing pay-TV service, Comcast isn&#8217;t quite in a position to  see positive territory. &#8220;I dont think well see growth in the first quarter,&#8221; he said.</p>
<p>Meanwhile in the fourth quarter, Comcast added 336,000 broadband customers, its best showing in that category in nearly two years. Comcast and other cable entities have been in a pitched battle with phone companies for that market. &#8220;The [phone company] overbuild has slowed in 2011. It was about 1.1 million homes versus 2.5 million in 2010,&#8221; Smit said on the call.</p>
<p>Broadband is now the biggest cash cow for cable companies, as the expanded use of video, gaming and other applications has made it much more necessary to have a fast Internet connection. Cable seems as well-positioned in this crucial area as it has ever been, and that will be a mitigating factor alongside whatever challenges come along on the video subscription side.</p>

			<content:encoded><![CDATA[<p>The Presidents Council of Advisors on Science and Technology (PCAST) issued a report on Feb. 7 on how to produce 1 million additional college graduates over the next decade with degrees in science, technology, engineering, and mathematics (STEM). Its an important report that should serve as a launching pad for the implementation of its recommendations, but also for additional explorations of the challenge that faces our nation.</p>
<p>The report, titled Engage to Excel, rightly establishes this numerical goal as crucial to maintaining US preeminence in the STEM fields &#8212; and, therefore, in the scientific and technological innovations that have made the United States a global economic powerhouse. The reports summary states:</p>
<blockquote><p>To meet this goal, the United States will need to increase the number of students who receive undergraduate STEM degrees by about 34 percent annually over current rates. Encouragingly, while this need may seem daunting, it can be accomplished with only a modest increase in the retention rate of STEM majors during the first few years of college. Thats because fewer than 40 percent of students who enter college intending to major in a STEM field complete college with a STEM degree today. Increasing the retention of STEM majors to just 50 percent would, alone, generate approximately three-quarters of the targeted one million additional STEM degrees over the next decade&#8230;</p></blockquote>
<p>The reports five overarching recommendations &#8212; to transform undergraduate STEM education during the transition from high school to college and during the first two years of undergraduate STEM education &#8212; are the following:</p>
<ul>
<li>Catalyze widespread adoption of empirically validated teaching practices.</li>
<p>
<li>Advocate and provide support for replacing standard laboratory courses with discovery-based research courses.</li>
</p>
<p>
<li>Launch a national experiment in postsecondary mathematics education to address the math preparation gap.</li>
</p>
<p>
<li>Encourage partnerships among stakeholders to diversity pathways to STEM careers.
</li>
</p>
<p>
<li>Create a Presidential Council on STEM Education with leadership from the academic and business communities to provide strategic leadership for transformative and sustainable change in STEM undergraduate education.</li>
</ul>
<p>As president of the nations oldest foundation devoted wholly to science, and a former Dean of Natural Sciences at a liberal arts college, I know full well the importance of these recommendations and their implementation. The foundation that I lead, Research Corporation for Science Advancement, is celebrating its 100th anniversary this year and has played a major role in supporting undergraduate research, providing more than 12,000 research grants in the sciences to colleges and universities across America during those 100 years. We understand the value of discovery-based research courses in particular and look forward to maintaining our commitment in that regard.</p>
<p>But the recommendations in this report should not only guide us but spur us on to explore additional improvements to the teaching of undergraduate STEM courses. Introductory science classes, for instance, are frequently used as a way of weeding out students instead of cultivating them. Course content should be changed to better reflect the process of science and its role in todays world. Content should be taught within the context of a larger societal issue, a relevant story or timely topic, such as environmental, health, or infrastructure issues. </p>
<p>Students should be introduced early on to the interdisciplinary nature of todays science and engineering. This would both reflect the reality of discovery and innovation and increase the likelihood that, if a science or engineering student chooses to leave one field of study for another, that student might go on to choose another field of science or engineering, rather than a completely different field.</p>
<p>Students should also be introduced to the importance of high-risk, high-reward research. To achieve that, at least some critical mass of faculty members who teach students must themselves be involved in such research. High-risk, high-reward research is an essential ingredient of innovation. Exposure to it would encourage students to question conventional wisdom and engage them in the truly transformative potential of science. </p>
<p>Adding 1 million additional STEM graduates who approach science from a conventional risk-averse perspective will not have the impact that we want and need as a nation. But we can maintain and expand our scientific and technological preeminence if those STEM graduates understand that the important scientific challenges ahead of us will be complex, will require an interdisciplinary approach, will be solved by innovative teams, and will progress as much through experimental failures as through successes.</p>
<p>In conjunction with all of this, our nations colleges and universities should reconsider what they reward through tenure and promotion decisions. Such decisions should no longer be based merely on the number of papers published or overhead dollars generated. Rather, they should also consider how many students of individual professors go on to major in their field or in any STEM field, and how many pursue advanced STEM degrees. Indeed, colleges and universities could even be judged and ranked by funding agencies not only on their ability to accrue funding dollars but also on their success in taking incoming, prospective science students all the way through to receiving science degrees. Such a ranking mechanism could provide a powerful incentive for change. </p>
<p>The PCAST report is highlighting a crucial need &#8212; not just for STEM fields but for future US employment and economic preeminence. It is launching our nation on the right trajectory, and the implementation of its five overarching recommendations should become a national priority. But they should not be seen as the only solutions needed. Engage to excel is correct, but we can be even more engaging on the way to producing 1 million additional college graduates with STEM degrees over the next decade.</p>
